The Bankruptcy Specialist will be responsible for processing and analyzing bankruptcy cases, including motions for relief from stay, client document review, and interaction, as well as coordinating court hearings. The ideal candidate will have a strong knowledge of bankruptcy laws, court procedures, and financial documentation related to bankruptcy cases.
JOB RESPONSIBILITIES & DUTIES:
Bankruptcy Case Processing & Analysis
- • Scrub accounts when receiving a new portfolio to determine if the account is active bankruptcy, collectible bankruptcy, or not collectible.
- • Understand the differences between Chapter 7, Chapter 11, Chapter 12, and Chapter 13 bankruptcies.
- • Analyze delinquency, pay history, and escrow analysis statements provided by the client.
- • Knowledge of bankruptcy schedules, petitions, and the claims process.
- • Knowledge of reaffirmation agreements filed and the rescinding process.
- • If an account involves real property, research to determine if it is secured or unsecured.
- • Research and obtain loan documents if needed.
- • Familiar with Chapter 11 plans, including Sub V Chapter 11 cases.
- • Some familiarity with state and district local bankruptcy rules.
Case Updates & Documentation
- Update case information, including Attorney, Trustee, and debtor address, as needed.
- Prepare Proof of Claim form 410 and, if necessary, 410A attachments.
- File various bankruptcy documents, including:
- Transfer of Claims
- Requests for Notices
- Withdrawal of Claim
- Satisfaction of Claim
- Notice of Final Cure
- Follow Chapter 7 cases to determine if they become asset cases and monitor bar dates.
- Review Chapter 13 Trustee account ledgers (NDC).
- Review Chapter 13 plans and amended plans over the 3- or 5-year term.
- Update the case system with notes when status changes.
- Familiar with mortgage deficiency and related documentation.
- Knowledge of deficiency calculations for mortgages and judgments.
- Upload documents into the software system.
Legal & Court Coordination
- Coordinate preparation and filing of bankruptcy motions with local counsel.
- Independently draft bankruptcy documents or pleadings for attorney review.
- Prepare litigation documents such as trial notebooks.
- Review incoming court mail with attorneys to determine the necessary actions and communicate recommendations to clients.
- Review bankruptcy mail and BNC mail for all clients; note all applicable accounts.
- Review Toyota accounts for bankruptcy filings and process according to contract, including reaffirmation agreements.
- Work directly with collectors on accounts with possible bankruptcy filings.
Communication & Compliance
- Communicate with Trustees, Trustee attorneys, and Debtor attorneys as necessary.
- Conduct research using platforms such as PACER and CM/ECF filing systems.
- Communicate with clients, debtor’s attorneys, court representatives, trustee offices, taxing authorities, and title companies as needed.
- Provide written and verbal communication regarding claim objections, motions for relief from stay, trustee final cure, payment change notices, objections to confirmation, post-petition fee notices, and other disputed mortgage matters.
- Serve as the first point of contact for assigned clients.
- Update internal and client communication systems as necessary.
Technology & Software Proficiency
- Proficiency in bankruptcy software and research tools, including:
- PACER
- CM/ECF
- Datatree
- ADR NDC
- TLO
- Qlaw
- Use online resources such as OpenCorporates, County Recorders, and Secretary of State (SOS) websites for research.
QUALIFICATIONS:
- 3 years of bankruptcy experience.
- 3 years of mortgage servicing experience (preferred).
- Strong analytical and problem-solving skills.
- Detail-oriented with the ability to multi-task.
- Excellent written and verbal communication skills.
- Ability to work in a fast-paced, high-volume environment under strict deadlines.
- Proficiency with Microsoft Word and Excel.
- Occasional overtime may be required.
